Amendment to WAC 461-08-330
The Legislature amended
RCW 90.58.185,
which currently provides authority to hear certain shoreline
cases with panels of three Shoreline Hearings Board members instead of the full 6-member Board.
Senate Bill 6165
expands the current authority to allow the Chair of the Board to designate additional
appeals for review by three-member panels based on factors such as complexity and precedential nature
of the case and the efficiency and cost-effectiveness of using a short board versus a full board.
This amendment was effective July 25, 2009.
On June 12, 2009, the Environmental Hearings Office (EHO) filed notice of proposed rulemaking. See
WSR 09-13-052.
The purpose of the rulemaking is to amend
WAC 461-08-330
to clarify that additional
appeals may be designated for three-member panels pursuant to the authority provided by
Senate Bill 6165.
A public hearing was conducted on July 24, 2009. No one attended, and no written comments were
received. The EHO adopted the proposed rule without change at its regularly scheduled meeting on
October 13, 2009. The final rule was filed on October 13, 2009. See
